Privacy Policy & Legal Agreements

This privacy policy governs your use of the software application RunGo ("RunGo") for mobile devices that was created by Leaping Coyote Interactive, LLC. RunGo is a voice navigation application for runners that offers turn-by-turn directions and route creation, in addition to basic tracking of run stats like pace, distance, and time.

Our Privacy Policy explains:

What information does RunGo collect, and how is it used?
RunGo collects basic profile data including email when a user create an account, this is used to for login communication directly with registered users.

RunGo also collects general anonymized usage data that does not identify you in any way. This data is used to improve the quality RunGo and identify any technical issues.

How to request Deletion of personal data
You can delete your routes and runs from routes.rungoapp.com, you can also unsubscribe from the RunGo newsletter. To request to delete your account completely contact support@rungoapp.com

Location
When you use RunGo with your mobile device's GPS enabled, we automatically collect information about your actual location, using GPS signals sent by your mobile device. RunGo uses this information to provide you with real-time navigation, tracking and statistics during your run. We may store the location information collected, along with the route name, time, and distance and user ID (if user is logged in). This data is used to improve the quality and relevancy of the curated routes we offer and make more routes available in the areas with the most users and help in offer improved support.

We only access location data while using or has started a run with the RunGo App. We don’t access location data at any other time. Background Location data is required to record your run while the device screen is off.

Route Creation
By creating and posting routes, you generate content that other RunGo users may access. RunGo reserves the right to create runs based on user-generated routes. You can store your routes as long as you want to. If you decide to remove a route, this can be done via the app website, or you can contact support@rungoapp.com to initiate the process. RunGo is not responsible for accuracy of runs. Roads and trails may change between the creation of a route and the time you run on it -- exercise caution and have a back-up plan when running a route.

Online Logbook
For registered logged in users, the RunGo Online logbook can store runs data information including, time, distance, locations, calories, elevation, route name and username. Runs are stores securely on the RunGo server for the user to access online. Allowing the user to see their detailed statistics and access their run history between from different devices.

Runs are uploaded as private by default and can be set to public by users. Runs can be removed from the online logbook by users via the RunGo App, website or by contacting support@rungoapp.com

Sharing on Third-Party Applications
If you choose to post, disclose, or otherwise share your run stats or route information on a third-party application or website, you need to comply with all the rules and regulations of the application or website. By choosing to share your route or run, you assume all responsibility for the information you disclose, if any. For instance, if you post a route starting from your place of residence, it will be visible on the application or website where you have chosen to share it. RunGo is not responsible for this voluntary sharing of information. We encourage caution and discretion in how you share your routes. RunGo cannot edit or remove shared posts on third-party applications or websites. If you need a post removed, please contact the relevant third-party application or website directly.

Health Kit Data (iOS only)
We access Health Kit's Heart Rate and Calories to display on RunGo. We do not share any Health Kit data with 3rd parties and do not use Health Kit data for any marketing purposes.

Subscriptions
When you subscribe to RunGo, you authorize, manage, and pay for the subscription through iTunes, Google Play or Stripe. RunGo does not see or collect your personal information. All transactions are handled by the iTunes Store, Google Play Store or Stipe.
iTunes Subscriptions You can subscribe monthly or annually to RunGo Premium to access to our premium features. Payment will be charged to iTunes Account at confirmation of purchase. Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period. Account will be charged for renewal within 24-hours prior to the end of the current period at the initial monthly or annual cost. Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings after purchase. Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.

Do third parties see and/or have access to information obtained by the Application?
Yes. We will share your information with third parties only in the ways that are described in this privacy statement. We may disclose User Provided and Automatically Collected Information:

• as required by law, such as to comply with a subpoena, or similar legal process;

• when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;

• with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement;

• if Leaping Coyote Interactive, LLC is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of this information, as well as any choices you may have regarding this information. What are my opt-out rights?

You can stop all collection of information by RunGo easily by uninstalling RunGo and contacting support@rungoapp.com to remove your RunGo account. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

Changes
This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy at this URL and informing you when you start the RunGo application. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes. You can check the history of this policy by Click here.

Consent
By using RunGo, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. “Processing,” means using cookies on a computer/handheld device and using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in Canada. If you reside outside of Canada your information will be transferred, processed and stored there under Canadian privacy standards.

This Terms of Service agreement (Agreement) is a legal agreement between you and Leaping Coyote Interactive Inc. (LCI) for the mobile application RunGo (RunGo). LCI is referred to as us, we and our in this Agreement. Our registered office is 1404-1233 W Cordova Street, Vancouver, BC. We are a company registered in British Columbia, Canada.

The terms below set out the Agreement between you and us for the download, installation, and use of RunGo, so please read this carefully. By downloading and using RunGo, you are agreeing to be bound by these terms. If you do not agree to all of the terms in this Agreement, you should not download or use RunGo.

Health and Safety
RunGo's purpose is to make runners lives easier by providing voice navigation, but does not guarantee that all routes are accurate and/or up to date. LCI is not responsible for damages or injuries incurred due to inaccurate or outdated routes, or through elements outside of LCI's control, including but not limited to construction, new roads, weather, time of day, or other people. Exercise caution and make sure you give due consideration to your environment and do not put yourself at risk of injury or harm.

You are responsible for ensuring that you are of an appropriate fitness level to use RunGo. Exercise general common sense in determining whether you are of adequate physical condition to use RunGo. If you are in any doubt, please consult a doctor or physician.

Privacy
The RunGo Privacy Policy explains how we treat your personal data and protect your privacy when using RunGo. By using RunGo, you agree that LCI can use such data in accordance with the Privacy Policy, and confirm that you have read the Privacy Policy so that you understand how we collect information, what information we collect, and how it is used.

Ownership of the App
RunGo is provided as is and on an as available basis without any representation, endorsement, or warranty of any kind, including but not limited to implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security, and/or accuracy.

We do not guarantee that the app will be (i) free of errors, viruses or bugs, or other defects; or (ii) that the app or any information displayed or distributed through the app or in the documentation will be accurate or complete; or (iii) that any defects in the app or documentation will be corrected.

You acknowledge that reliance on any such information shall be at your sole risk.

To the fullest extent permissible by law, including in your local jurisdiction, we exclude all liability for any personal injury, loss or damage, including any liability or damage to any device or computer system. Our entire liability to you, and to the extent we can not exclude it, where permissible by law, shall be limited to the purchase price of the app.

In the event that Apple refunds you the purchase price in accordance with the iTunes terms of sale, then both Apple and we will have no further warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform with the foregoing warranty. As a condition of the refund, you are required to delete the app.
